An earlier version of this page, written in 2022, listed places to buy CBD bud in Ireland. We have rewritten it because that advice was wrong for Ireland and could get readers into trouble. CBD bud, also sold as CBD flower or hemp flower, is not a legal product to buy or sell in Ireland. This page explains why, what the risks are, and the legal CBD products you can buy instead.
The short answer
No, CBD bud is not legal in Ireland. Under the Misuse of Drugs Acts, the flowering or fruiting tops of the cannabis plant are controlled, and Irish law does not make an exception for hemp flower with low THC. Licensed hemp growers in Ireland are permitted to grow hemp for seed and fibre, and the leaves and flowers are not allowed to be sold for consumption. Shops in Ireland that sold CBD flower have had stock seized by Gardaí.
Why “low THC” does not make it legal
A common argument online is that hemp flower is legal because it contains less than 0.2% or 0.3% THC. Those figures relate to which hemp varieties farmers can grow under EU rules. They are not a limit that makes the flower legal to sell or possess in Ireland. In Irish law, the plant parts matter, not only the THC percentage. That is why CBD oils made from processed extracts, tested to show no THC, are treated differently from the raw flower.
Risks of buying CBD bud
- Legal risk: possession can be treated as possession of cannabis.
- Drug testing: hemp flower contains some THC and can lead to a positive roadside or workplace drug test.
- Driving: drug-driving laws in Ireland apply to THC regardless of whether you feel impaired.
- Unknown contents: unregulated flower may be sprayed with synthetic cannabinoids or HHC, or contaminated with pesticides or mould.
- Smoking: smoking any plant material harms the lungs, whatever it contains.
What about HHC, THCP and delta-8?
Some sellers moved from CBD flower to semi-synthetic cannabinoids such as HHC, THCP and delta-8 THC, sometimes sprayed onto hemp flower or sold in vapes and sweets. These are intoxicating and are not CBD. HHC became a controlled drug in Ireland on 29 July 2025. Products containing these substances have been linked to people, including teenagers, needing hospital treatment. Avoid them.

Herbal teas without hemp
If what you enjoyed about flower was a calming ritual, caffeine-free teas such as chamomile, lemon balm or rooibos can be part of a wind-down routine. Hemp leaf teas are best avoided in Ireland for the same legal reasons as flower.

What the law says, briefly
- Cannabis, including its flowering tops, is controlled under the Misuse of Drugs Acts 1977 to 2016.
- Hemp cultivation requires a licence from the Minister for Health, administered by the HPRA, and only approved low-THC varieties may be grown.
- CBD food supplements are overseen by the Food Safety Authority of Ireland and must not contain THC.
- HHC has been a controlled drug since 29 July 2025.

Northern Ireland and travel
In Northern Ireland, UK law applies, and CBD flower is also treated as a controlled drug. Many other countries also restrict hemp flower. Never travel with it.

Why CBD bud became popular, and why it caused confusion
From around 2018, CBD shops opened across Europe selling dried hemp flower in jars, often labelled “not for human consumption” or “for collectors”. Some EU countries took a more relaxed approach at the time, and online sellers shipped across borders. In Ireland, a number of shops began selling it too, believing low-THC hemp was outside drug laws. Gardaí took the view that the flowering tops were controlled cannabis, and stock was seized. Several businesses stopped selling flower as a result, and the legitimate Irish CBD industry moved to oils, capsules, gummies and topicals made from tested extracts.
The confusion lingers because some websites based outside Ireland still market flower to Irish customers, often with outdated or overseas legal advice.
How the rules differ across Europe
The legal position on hemp flower varies widely between EU countries and has changed several times in recent years. Some countries tolerate low-THC flower in limited circumstances; others, like Ireland, treat it as controlled cannabis. France, for example, has moved back and forth in the courts and in 2026 also withdrew CBD food products from sale. Because the picture keeps shifting, rules in another country are never a reliable guide to what is allowed in Ireland.
How to tell a legal CBD product from flower
- Legal CBD products are oils, capsules, gummies or creams with a full food-supplement or cosmetic label.
- They state the CBD content in milligrams and have a batch number.
- They come with a lab report showing THC is not detected.
- They do not look, smell or get sold like cannabis. Dried plant material in jars, pre-rolls or “aroma” products are red flags.
What to do if you already have some
Do not drive or go to work after using it, as THC may be present. Do not give it to anyone else, and keep it away from children and pets. If you are worried about a possible legal issue, a solicitor can advise you confidentially.
Is the law likely to change?
Ireland’s Citizens’ Assembly on Drugs Use reported in 2024 and the Oireachtas has continued to debate drug policy. Any change to the law on cannabis would need new legislation. Until that happens, CBD flower remains controlled. We will update this page if the law changes.
Quick checklist before you buy any hemp product in Ireland
- Is it an oil, capsule, gummy or cream rather than dried plant material?
- Does the label state CBD in milligrams, a batch number and a business address?
- Is there an independent lab report for that batch?
- Does the report show THC is not detected, and no HHC or other synthetic cannabinoids?
- Does the seller avoid medical claims?
- Is the seller based in Ireland or the EU, with real contact details?
If the answer to any of these is no, walk away.
Choosing a properly labelled, lab-tested CBD oil or capsule gives you a product that is legal, measurable and consistent from bottle to bottle, without the legal and health risks that come with flower.
