Poland has one of the largest CBD markets in Central Europe, with CBD oils widely visible in shops and online. Behind that visibility is a more complicated legal picture. This guide explains the rules in 2026, how enforcement works, how to buy safely, and what to know when travelling.
Is CBD legal in Poland?
CBD is not a controlled substance in Poland. Since a 2022 amendment to Poland’s drug prevention law, industrial hemp may contain up to 0.3% THC, in line with the EU. However, CBD extracts in food are treated as an unauthorised novel food under EU rules, and Poland’s Chief Sanitary Inspectorate (Główny Inspektorat Sanitarny, known as Sanepid) has acted against CBD food products, including withdrawals and seizures from some distributors since 2023. CBD cosmetics notified through the EU cosmetics portal are generally tolerated.
What that means in practice
- CBD oils are widely sold, often labelled as cosmetics or “collector’s” products to work around food rules; this is a grey area.
- CBD cosmetics such as creams and balms are the most clearly legal category.
- Hemp seeds and hemp seed oil are ordinary foods.
- Dried hemp flower is sold in some shops but carries legal risk, especially if THC exceeds the limit; avoid it.
- Products containing THC, HHC or other semi-synthetic cannabinoids should be avoided.
Medical cannabis in Poland
Medical cannabis has been available in Poland on prescription since 2017, dispensed through pharmacies. Licensed CBD medicines such as Epidyolex are authorised for specific rare forms of epilepsy. These are separate from consumer CBD products. In recent years Polish authorities have tightened rules on online prescribing of medical cannabis.
Buying safely in Poland
Look for an independent lab report for the batch, CBD content in milligrams, a THC result within the legal limit, a full label in Polish and the responsible business in the EU. Prices for a 10ml 10% oil typically range from around 150 to 300 złoty depending on brand. Compare price per milligram rather than bottle price, and avoid products making health claims.
Driving and drug testing
Poland enforces drug-driving laws strictly, and roadside tests can detect THC. CBD itself is not intoxicating, but products containing THC could cause a positive result. Use only products with clear lab results and do not drive if CBD makes you drowsy.

Choosing a strength and type
CBD oils sold in Poland usually range from about 5% to 30%. A 10% oil (1,000mg in 10ml) gives roughly 5mg of CBD per drop, which makes small, measured amounts easy, so many first-time buyers start there. Higher strengths are not stronger in effect, only more concentrated: fewer drops, and often a lower price per milligram. Full spectrum extracts keep a wide range of hemp compounds, broad spectrum extracts have THC removed, and isolates are CBD on its own. Whatever the label says, the lab report is what matters: check the CBD content matches the bottle and that THC is within the legal limit or not detected. Follow the recommended daily serving on the label and do not exceed it.
The EU picture in brief
Across the EU, CBD sits in a grey area. No CBD food or supplement has yet been authorised under the EU novel food rules, so each country decides how strictly to enforce them, which is why rules differ so much between neighbours. Hemp may be grown with up to 0.3% THC in the plant. In 2020 the EU Court of Justice ruled in the Kanavape case that CBD is not a narcotic and that member states should not ban CBD lawfully produced elsewhere in the EU without good reason. CBD cosmetics are generally allowed across the EU. Rules are changing quickly, so check official sources before you buy or travel.
Six checks before you buy, anywhere
- An independent lab report with a batch number matching your product.
- THC not detected (or below the local legal limit).
- CBD stated in milligrams per bottle and per serving.
- A full label in a language you understand, with the business address.
- No medical claims.
- A seller with real contact details in the EU.
Travelling with CBD to or from Poland
Before travelling, check the rules in your destination and any country you pass through. Keep CBD in its original labelled packaging, carry a copy of the lab report, and follow airport liquid limits. Never travel with hemp flower or any product containing THC, HHC or other controlled cannabinoids. Some countries outside the EU treat any cannabis-derived product as a serious drug offence.
Using CBD safely
- Talk to a doctor or pharmacist first if you take any medication; CBD can interact with some medicines.
- Keep within the recommended daily serving on the label.
- CBD is not recommended in pregnancy, while breastfeeding, or for children.
- Do not drive if it makes you drowsy.
- CBD supplements cannot claim to treat any illness.
Choosing a CBD cosmetic in Poland
Because cosmetics are the clearest legal category, it helps to know how to judge them. A properly notified EU cosmetic lists ingredients with INCI names (CBD appears as “cannabidiol”), the responsible person in the EU, a batch number and a period-after-opening symbol, and is notified on the EU cosmetics portal (CPNP). Cosmetics cannot claim to treat illness. Patch test new products, avoid broken skin, and compare products by total CBD per pot.
Hemp in Poland
Poland has a long tradition of growing hemp for fibre and seed, and the industry has grown since the THC limit rose to 0.3% in 2022. Hemp seeds, hemp seed oil and hemp protein are ordinary foods in Polish shops. They are nutritious but contain little or no CBD.

How Poland compares with its neighbours
Germany has legalised limited adult use of cannabis but still treats CBD foods as unauthorised novel foods. Czechia has a relatively liberal approach to hemp and higher THC limits for some products. Slovakia removed CBD from its psychotropic list in 2021 but does not allow oral CBD. Lithuania sets strict THC limits for foods. Rules change frequently, so check before crossing borders with any CBD product.
